Ratio Decidendi

The High Court lacks jurisdiction to hear and determine appeals concerning the use, occupation, and title to land following the establishment of the Environment and Land Court by Act No. 19 of 2011. Practice Directions issued by the Chief Justice require that such matters be transferred to the Environment and Land Court unless they are already part-heard by the High Court. Since the present appeal is not part-heard and concerns land, it must be transferred to the Environment and Land Court, which is vested with the requisite jurisdiction. The court cannot arrogate to itself jurisdiction not conferred by the Constitution or statute.
