The court held that while the Minister for Finance has a statutory duty under Section 5 of the Kenya Information and Communications Act to vest or dispose of the assets and liabilities of the defunct KPTC, and is not permitted to refuse to act, the decree the applicant sought to enforce was already time-barred. Section 4(4) of the Limitation of Actions Act provides a strict twelve-year limitation period for enforcement of judgments. The judgment in Meru CMCC No. 34 of 1991 was delivered on 29th May, 1996, and the present application was filed on 15th February, 2012, well beyond the statutory period.
