Ratio Decidendi

The court found that the 3rd Respondent, having neither filed pleadings nor submissions in support of its preliminary objection, failed to provide a legal basis for the objection. The points raised in the objection could not be derived from any pleadings, and the objector did not canvass or substantiate them. In line with the principles set out in Mukisa Biscuit, a preliminary objection must arise from the pleadings and be supported by argument. The absence of both rendered the objection unsustainable. Consequently, the court struck out the preliminary objection with costs to the petitioners.
