The High Court found that although the appellant was convicted on his own plea of guilty and the seriousness of wildlife offences warrants deterrent sentences, the sentence imposed by the trial court was excessive in the circumstances. The record showed the appellant was given an opportunity to mitigate, and the minimum statutory penalty was a fine of one million shillings or imprisonment for not less than five years. The trial court imposed a fine of twenty million shillings or ten years imprisonment in default, which was disproportionate to the value of the trophies and the circumstances.
