The Court of Appeal held that the applicant failed to satisfy both limbs required for a stay of execution under Rule 5(2)(b) of the Court of Appeal Rules. The court was not persuaded that the intended appeal was arguable based on the record before it. Even assuming arguability, the applicant did not demonstrate how the success of the appeal would be rendered nugatory if stay was refused.
