Ratio Decidendi

The tribunal found that the applicant provided a plausible explanation for the delay in filing the appeal, namely that the decision was improperly served on an unskilled staffer rather than the counsel on record. The respondents did not controvert this assertion or explain why service was not effected on the applicant's lawyers. The tribunal held that, in the interests of substantial justice and given the existence of an arguable appeal, the extension of time was warranted. Furthermore, to prevent the appeal from being rendered nugatory, a stay of execution of the impugned decision was also justified. Each party was ordered to bear its own costs.
