Procedural Posture

Miscellaneous Application / Ruling on Application for Leave to Appeal Out of Time

  1. 1 Whether the applicants have established sufficient cause to warrant extension of time to file an appeal out of time.
  2. 2 Whether the delay in filing the appeal was adequately explained and excusable.

Ratio Decidendi

The court found that the applicants failed to provide satisfactory reasons for the delay in filing the appeal. Although they claimed the file was missing and that they were unaware of the ruling, they did not annex evidence of their efforts to trace the file or explain the further delay after the file was traced. The delay of over two years and three months was deemed inordinate. The court held that the applicants did not lay a sufficient basis to warrant the exercise of discretion in their favour to extend time for filing the appeal. Consequently, the application for leave to appeal out of time was dismissed.
