Ratio Decidendi

The applicant, having set out the deceased's earnings in the plaint, knew or ought to have known that the magistrate's court lacked jurisdiction. The only remedy for a suit filed without jurisdiction is to withdraw it and file a compliant suit in the appropriate court. The court emphasized that jurisdiction is fundamental and cannot be conferred by consent or subsequent application. Therefore, the application to transfer the suit was dismissed for lack of merit.
