The court found that the grant of letters of administration was obtained by Francis Kaburu without the required written consent or renunciation from all beneficiaries, in breach of Rule 26(2) and Rule 40(8) of the Probate and Administration Rules. The evidence established that the applicant and other beneficiaries were not properly notified or did not consent to the petition or confirmation of the grant. The court determined that only one parcel of land, Abothuguchi/Upper-Kaongo/836, formed part of the deceased's estate, as there was no evidence that Abothuguchi/Igane/717 belonged to the deceased. Applying Meru customary law, the court held that the estate should be divided equally...
