The court found the will to be formally valid under section 11 of the Law of Succession Act, as it was properly signed and attested. However, the will only made a bequest to the Petitioner and did not dispose of the entire estate or make reasonable provision for all dependants. Ambiguous provisions in the will regarding life interest were held to be of no effect. The court determined that gratuities, pension, and Sacco account, not specifically disposed of or nominated, should be treated as part of the estate and distributed equally among the Petitioner and all children.
