Despite being served with the orders, the applicant ploughed and planted maize on the land. The court found that to grant the applicant leave to harvest the maize would be an affront to the rule of law, an abuse of the court process, and contrary to public policy. The court emphasized that it cannot assist a party to benefit from their own disobedience of court orders. Accordingly, the application for stay and leave to harvest the maize was dismissed with costs to the respondent.
