The court found that the sale agreement dated 28th August 1985 between the Plaintiff and the 1st Defendant was void for want of Land Control Board consent, as required by section 6 of the Land Control Act. Consequently, there was no valid contract upon which a claim for specific performance could be based. The Plaintiff's claim was also statute-barred under section 7 of the Limitation of Actions Act, as it was filed more than twelve years after the cause of action arose. The court held that the claim for trespass and injunction was dependent on the validity of the contract and could not succeed independently.
