Ratio Decidendi

The court found that the Applicants provided a reasonable explanation for the delay in filing the appeal, namely the loss and subsequent replacement of the 2nd Applicant's cell phone, which disrupted communication with their advocates. The delay of 15 days beyond the statutory period was not considered unreasonable. The court held that the discretion to extend time under section 79G of the Civil Procedure Act should be exercised in the Applicants' favour, as the Respondent would not suffer undue prejudice and there were no stay of execution orders in place. The application was therefore allowed to the extent of granting leave to file an appeal out of time within 14 days.
