The court found that although the deceased was registered as the owner of the suit parcel of land following a prior court decision, his conduct in allowing the Objector and her late sister to reside on the land for over thirty years constituted an acknowledgment of their beneficial interest. The court held that the deceased, by his actions, held part of the land in trust for his siblings. The Objector and the children of her late sister were therefore entitled to inherit the parcels of land they had occupied.
