The High Court found that while the trial magistrate correctly accepted the unchallenged evidence of the deceased's employment and monthly salary, the dependency ratio applied was erroneous. The correct dependency ratio should have been 1/3, as conceded by the respondent and supported by the evidence that the deceased's mother was the sole dependent. The court also found that the multiplier of 25 years was reasonable given the deceased's age and circumstances. The court reduced the award for loss of dependency to Kshs 2,104,000 after accounting for acceleration of the lump sum payment.
