Ratio Decidendi

The court found that the restriction registered against the applicant's land had no legal basis to subsist, as the criminal case that prompted its registration had been finalized and there was no pending dispute over the land. The applicant demonstrated that he is the registered proprietor and that continued restriction would unjustly interfere with his proprietary rights. The court therefore granted the order for removal of the restriction and any other encumbrances. The application by the respondent's advocate to cease acting was rendered superfluous by the substantive determination of the applicant's application.
