Specifically, there was no finding as to whether the metal cutter found in the appellant's possession was made or adopted for use in burglary, theft, or cheating, as required by law. The prosecution did not prove beyond reasonable doubt that the article was intended for use in committing a felony. The trial court also improperly shifted the burden of proof to the defence and failed to address the key issues for determination. As a result, the conviction was unsafe and could not stand.
