The court found that the delay of almost four years in filing the application for extension of time was not reasonably explained. The illness of two family members did not justify the inaction of the remaining applicants. Furthermore, the court was not satisfied that the intended appeal had any real prospects of success, as the grant had already been issued and the land subdivided and transferred. The court concluded that the applicants failed to meet the threshold for the exercise of discretion to extend time and that granting the application would prejudice the respondent, who had already completed the transmission and subdivision of the land.
