Ratio Decidendi

The court found that the CDF circular dated 24.06.2013 did not apply retroactively to the claimant's contract, as it was not incorporated into the terms of employment. The claimant's contract, originally for one year, was renewed by conduct into the third year. The respondent's termination of the contract before the expiry of the renewed term was premature and in breach of the agreed terms. Relying on precedent, the court held that the claimant was entitled to salary for the unexpired 11 months of the third year at the contractual rate, but not to gratuity or underpayment based on the circular. The court awarded the claimant Kshs. 165,000 for the unexpired period and costs of the suit.
