The court found that although there was a delay of over one month in filing the application for stay, it was not so inordinate as to bar the applicant from seeking relief. The applicant had filed a notice of appeal and raised issues for determination on appeal. To ensure that the appeal is not rendered nugatory and in the interest of justice, the court held that a conditional stay of execution was appropriate. The court ordered that half of the decretal sum be deposited in an interest-earning joint account in the names of both parties' advocates, and the other half be released to the claimant within 30 days.
