Procedural Posture

Civil Appeal / Ruling on Applications for Stay of Execution and for Implementation of Grant

  1. 1 Whether there is a pending appeal or application before the Court of Appeal to justify a stay of execution of the grant.
  2. 2 Whether the respondents are entitled to orders compelling the Land Registrar to register LR. Kyeni/Mufu/4210 in their joint names as per the grant.
  3. 3 Whether the applicant fraudulently registered the land in his sole name contrary to the grant.

Court Disposition

Applicant's application for stay dismissed; respondents' application for implementation of grant allowed.

  • The Land Registrar Embu is ordered to include the names of Augustine Muturi Mairani, Anthony Nyaga Mairani, and John Njagi Mairani in the register for LR. Kyeni/Mufu/4210.
