The High Court found that both the Embu District Land Disputes Tribunal and the Eastern Province Appeals Committee acted outside their statutory jurisdiction by purporting to determine issues relating to title and subdivision of land parcel Ngandori/Kirigi/4793. The Land Disputes Tribunal Act expressly excludes matters of title from the jurisdiction of these tribunals, limiting them to disputes over boundaries, occupation, or trespass.
