Ratio Decidendi

The court found that the facts surrounding the conduct of the union elections were highly contested and could not be resolved at the interlocutory stage. The allegations of election malpractice raised by the Claimant required a full hearing with evidence, as they were substantive and not suitable for determination on affidavit evidence alone. The court therefore declined to grant the interim orders sought, including restraining the registration of officials and nullifying the elections, and directed that the main claim proceed to hearing on a priority basis.
