The court found that the applicants failed to provide any explanation for the delay in filing the appeal, as there was no affidavit from the applicants themselves explaining why instructions to appeal were not given in time. The supporting affidavit was sworn by an officer of the insurance company, who did not state any reason advanced by the applicants for the delay. The court held that, in the absence of a satisfactory explanation for the delay, there was no material upon which it could exercise its discretion to extend time. Consequently, without an extension of time, the request for stay of execution could not be granted. The application was therefore dismissed with costs.
