The appellate court found that the Respondent, as a passenger, could not be held contributorily negligent in the absence of any evidence showing his contribution to the accident. The Appellant failed to adduce any evidence to support the allegation of contributory negligence, and merely stating it in the defence was insufficient. Furthermore, the Appellant did not enjoin the driver of the other vehicle as a party, which was fatal to his case on liability. On quantum, the court held that while the trial court's discretion in awarding damages should be respected, the award of Kshs 1,000,000 was inordinately high compared to similar cases and the injuries sustained.
