Ratio Decidendi

The court found that the appellants had demonstrated sufficient cause for stay of execution, as the grounds of appeal were arguable and not frivolous. The application was made without unreasonable delay, and the appellants would suffer substantial loss if evicted before the appeal is heard. Although the appellants did not offer security in their affidavits, the court exercised its discretion to order payment of Kshs. 100,000 within seven days and Kshs. 9,000 per month thereafter as security. The stay of execution was therefore granted on these terms, pending the determination of the appeal.
