The lower court is functus officio, and the appellant is entitled to appoint new counsel for the appeal without seeking leave. Therefore, the preliminary objection challenging the appellant's advocates' locus standi was without merit and was dismissed. The issue of duplicate applications for stay pending appeal was not suitable for determination by preliminary objection and should be addressed in the normal course.
