The court held that, although the police abstract initially indicated the appellant as owner, this was rebutted by a motor vehicle search and an admission by the 2nd defendant (Watu Credit Limited) that it was the registered owner. There were no competing claims of ownership, and thus the appellant should not have remained a party. The trial court also erred by failing to address the alternative prayer for security for costs. The appeal was allowed, the lower court's ruling set aside, and the appellant's application to be struck out as a party was granted.
