Procedural Posture

Criminal Revision / Ruling on Application for Revision of Sentence

  1. 1 Whether the High Court has jurisdiction to review its own sentencing decision after an appeal has been determined.
  2. 2 Whether the application for revision of sentence is merited in light of section 333(2) of the Criminal Procedure Code.
  3. 3 Whether the applicant is entitled to a further reduction or review of sentence.

Ratio Decidendi

The High Court lacks jurisdiction to review its own sentencing decisions after an appeal has been determined. The powers of revision under section 362 of the Criminal Procedure Code and Article 165 of the Constitution are limited to supervisory jurisdiction over subordinate courts, not the High Court's own decisions. The court is functus officio regarding its own judgment, and the applicant's remedy, if any, lies elsewhere. The application for revision is therefore incompetent and constitutes an abuse of the court process.
