The court found that both the appellant's right of appeal and the respondent's right to enjoy the fruits of judgment must be balanced. The appellant filed the application for stay promptly and offered to deposit security. The court held that conditional stay of execution is justified to allow the appeal to be heard on its merits without rendering it nugatory, while also securing the respondent's interests. Accordingly, the court granted stay of execution on condition that the appellant deposits half the judgment sum in court within 30 days, failing which the stay would lapse.
