The court held that the appropriate award for general damages should not exceed Kshs. 1,000,000 in such circumstances, but taking into account inflation and the specific facts, substituted an award of Kshs. 1,500,000. On special damages, the court determined that only Kshs. 6,500 was strictly proved, as the receipts for medical expenses did not bear the respondent's name and were therefore disregarded.
