Procedural Posture

Civil Suit / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the judgment delivered on May 13, 2021, being a negative order, is capable of being stayed pending appeal.
  2. 2 Whether the plaintiff has satisfied the conditions for grant of stay of execution under Order 42 Rule 6 of the Civil Procedure Rules.

Ratio Decidendi

The court found that the judgment delivered on May 13, 2021, was a negative order, as it dismissed the plaintiff's suit with no order as to costs and did not impose any positive obligation capable of execution. Citing established case law, the court held that negative orders are not amenable to stay of execution, as there is nothing to execute. The court further noted that granting a stay in such circumstances would have the effect of reviving a dismissed suit, which is not permissible at this stage. Consequently, the plaintiff's application for stay of execution pending appeal was dismissed for lack of merit. Each party was ordered to bear their own costs of the application.
