The court found that the applicant failed to provide a satisfactory explanation for the delay in filing the appeal. The record showed that the ruling was delivered in the presence of both counsel, and although a soft copy was sent later, there was no evidence that the applicant's counsel made any effort to obtain the ruling promptly. The application for enlargement of time was filed more than three months after delivery of the ruling without sufficient justification. Applying the settled principles on extension of time, the court declined to exercise its discretion in favour of the applicant and dismissed the application with costs to the objector.
