The court found that the plaintiff failed to prove the existence of a trust in his favour over the suit property, as there was no evidence that the land was given to him by his mother or that his brother Jacob Cheligo held it in trust for him. The defendant's evidence showed he lawfully acquired the suit property through purchase from Jacob Cheligo and other neighbours, with the parcels amalgamated to form the suit property. The court further held that the plaintiff was estopped from challenging the defendant's registration on grounds of fraud, as the issue had already been determined by the Land Adjudication Tribunal and on appeal to the Minister, both of which the plaintiff lost....
