Criminal Petition / Judgment on Resentencing Application

  1. 1 Whether the Supreme Court decision in Muruatetu applies to mandatory life sentences for defilement.
  2. 2 Whether the applicant's sentence was unconstitutional under Article 50(2)(p) of the Constitution.
  3. 3 Whether the High Court is functus officio after having dismissed the applicant's appeal.

Ratio Decidendi

The court held that the Supreme Court's decision in Muruatetu was expressly limited to the mandatory death sentence for murder and did not apply to mandatory life sentences for defilement under the Sexual Offences Act. The applicant's sentence was lawful and within the discretion of the trial court, and there was no evidence of improper exercise of that discretion. Furthermore, the High Court, having already dismissed the applicant's appeal, was functus officio and lacked jurisdiction to entertain a resentencing application on the same matter. The application for resentencing was therefore dismissed.
