The court found that while the applicant's appeal was arguable, he failed to satisfy the second limb of the test for stay of execution, namely, that the appeal would be rendered nugatory if stay was not granted. The applicant had demolished a boundary wall without court authorization and failed to comply with the Environment and Land Court's order to reconstruct it. He had also been cited for contempt and had not purged the contempt. The court held that a party in contempt cannot be entitled to the equitable remedy of stay of execution pending appeal. Consequently, the application for stay was dismissed with costs.
