Ratio Decidendi

The High Court found that the trial court failed to give the applicant an opportunity to mitigate before sentencing, and that the sentence of Kshs. 100,000 fine or 12 months imprisonment was harsh and excessive in the circumstances, especially as the applicant was a first offender and the value of the seized busaa was not stated. Exercising its revisionary jurisdiction, the High Court substituted the sentence with a fine of Kshs. 50,000 or, in default, seven months imprisonment, and found that the applicant had already served the substituted default sentence in full. The applicant was ordered to be released forthwith unless otherwise lawfully held.
