Although the suit in the lower court was filed at a time when the Magistrate's Court lacked jurisdiction to hear land matters, the recent appellate decision in Civil Appeal No. 287 of 2016 clarified that Magistrates Courts now have jurisdiction over such matters. In the interest of justice and in accordance with Article 159(2)(d) of the Constitution, which requires courts to administer justice without undue regard to procedural technicalities, the Environment and Land Court exercised its discretion to transfer the suit to itself for hearing and determination.
