The victim, who is the applicant's mother, forgave him and requested a non-custodial sentence. The court determined that a community-based rehabilitation sentence would better serve the interests of justice, the applicant's family, and the community, as it would allow the applicant to care for his children and facilitate his reintegration. Accordingly, the custodial sentence was reviewed and substituted with a probation sentence for the remainder of the term.
