The applicants' apprehension that execution would render the appeal nugatory was considered, especially given the respondent's admission of financial incapacity to refund the decretal sum if the appeal succeeded. The court balanced the interests of both parties and determined that justice would be served by allowing the extension of time to appeal, on condition that the decretal sum be deposited in a joint interest-earning account or in court within 30 days.
