Ratio Decidendi

The High Court has jurisdiction under Section 7 of the Appellate Jurisdiction Act to extend time for giving notice of intention to appeal from its own judgment. The Petitioners provided a satisfactory and plausible explanation for the delay: they were not notified of the change in judgment delivery date, were absent at delivery, and only received a certified copy of the judgment on 14th February 2024 despite promptly requesting it. The delay in obtaining the judgment was not attributable to the Petitioners. Upon receipt, they acted without undue delay in filing the application for extension. The Respondent failed to demonstrate any prejudice that would result from granting the extension....
