The tribunal found that the respondent did not file any reference or objection to the notice of termination of tenancy dated 23rd May 2023, as required by Section 6(1) of the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act. The respondent also did not dispute the notice during the proceedings. Consequently, the notice took effect on 1st August 2023, lawfully terminating the tenancy. Regarding rent arrears, the tribunal accepted the respondent's admitted figure of Kshs.79,000/- as at February 2024, as there was no documentary evidence to support the applicant's higher claim.
