Ratio Decidendi

The court found that while the negligence of counsel is not generally a ground for granting extension of time, the discretion under Order XLIX rule 5 of the Civil Procedure Rules allows the court to enlarge time even after the prescribed period has lapsed. The court considered that the error was due to the advocate's clerk, now deceased, and that justice would be better served by allowing the 2nd Defendant to file his Defence rather than penalizing the client for his advocate's negligence. The court therefore exercised its discretion to grant the extension, but ordered that the costs occasioned by the application and the orders be borne personally by the advocate responsible for the error.
