Ratio Decidendi

The High Court found that while the trial magistrate properly assessed liability and considered the documentary evidence and submissions, the award for general damages was excessive and should be reduced to Kshs.2,000,000. The award for loss of future earnings was also excessive as it did not account for the 50% incapacity; thus, it was reduced by half. The court held that the issue of jurisdiction under the Work Injury Benefits Act was not properly raised at trial and, in any event, there was no evidence that the injury occurred in a workplace covered by the Act. The appeal was therefore partly successful, with the damages reduced and costs apportioned accordingly.
