The objection raised by the 1st respondent regarding the validity of the grant was misplaced, as such challenges should be addressed before the court that issued the grant, not the appellate court. There were no court orders revoking or prohibiting the use of the grant, nor any declaration of nullity. Therefore, the applicant was entitled to be substituted as the legal representative of the deceased in the pending application. The application for substitution was merited and allowed, with costs in the appeal.
