Ratio Decidendi

The court found that the applicant's deposition that his previous advocate withdrew the appeal without his authority or consent was unchallenged. The court accepted that the withdrawal was made without the applicant's knowledge and was therefore mistaken or fraudulent. Given that the respondent did not oppose the application and in light of the applicant's right to a fair hearing, the court exercised its discretion under Rule 68(3) of the Court of Appeal Rules to reinstate the appeal. The court concluded that the interests of justice required that the appeal be heard on its merits.
