Procedural Posture

Judicial Review Application / Ruling on Contempt Application

  1. 1 Whether the 1st respondent was in contempt of court orders issued on 21st February, 2023.
  2. 2 Whether the stay order granted by the court was sufficiently clear and specific to be enforceable.
  3. 3 Whether the application for committal properly identified the alleged contemnor as required by law.

Ratio Decidendi

The court found that the stay order purportedly breached was not sufficiently clear or specific as to what registration was barred, making it impossible to determine whether it had been breached. Furthermore, the application for committal failed to identify with precision the individual alleged to have committed contempt, as required by law. The lack of specificity in both the order and the application rendered the contempt proceedings fatally flawed. Consequently, the application was dismissed as it did not meet the legal threshold for committal for contempt.
