The Tribunal found that the landlord's notice to terminate the tenancy was invalid because it was issued while the tenant was still within the paid-up rent period, as per the tenancy agreement dated 17th December 2022, which required rent payment every six months. The next rent installment was not due until 17th May 2023, yet the notice was issued on 7th February 2023. Furthermore, the landlord's stated intention to use the premises for his own use was contradicted by his affidavit, which revealed he simply wished to evict the tenant and find another occupant.
