The Tribunal held that it lacked jurisdiction to hear and determine the complaint because the complainant failed to make any attempt to resolve the dispute through the party's internal dispute resolution mechanism (IDRM) as required by Section 40(2) of the Political Parties Act. The complainant's justification that the matter was overtaken by events was not supported by evidence, especially given the seven-day window between publication of the party list and filing of the complaint.
