Ratio Decidendi

The court found that the Plaintiff failed to establish a prima facie case for the grant of a temporary injunction. The surveyor's report indicated that the Plaintiff's land had encroached onto the 2nd Defendant's parcel, undermining the Plaintiff's claim of encroachment by the Defendants. The Plaintiff's photographic evidence was also found inadmissible due to lack of certification as required by law. Consequently, the Plaintiff did not meet the threshold for the grant of a temporary injunction as set out in Giella v Cassman Brown. The application was dismissed with costs to the Defendants, and the interim orders previously granted were vacated.
